Right of Publicity

By signing this Agreement, you immediately grant Forza Tuning and Performance the unrestricted, worldwide, royalty‐free right to use, reproduce, publish and otherwise distribute your name, photograph, video presence, personal story and/or likeness (collectively, “Likenesses”) in advertising and in Forza Tuning and Performances’ promotional materials, in any and all formats, platforms or other media or social media now existing or hereafter created, and you hereby waive all claims for remuneration for such use and you release and forever discharge Forza tuning and Performance from any and all claims and demands arising out of or in connection with the use of Likenesses. This authorization may be cancelled at anytime (for purposes of future uses only) by contacting Forza Tuning and Performance by email or written letter.

Photo Use Release

I hereby grant and authorize Forza Tuning and Performance the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or videos taken of me or my vehicle by Forza Media Department to be used in and/or for legally promotional materials including, but not limited to, social media posts, flyers, brochures, advertisements, fundraising letters, annual reports, websites, social networking and media, and other digital or printed materials, without payment or any other consideration. This authorization extends to all languages, media, formats and markets now known or hereafter devised. This authorization shall continue indefinitely, unless I otherwise revoke said authorization in writing.

I understand that these materials will become the property of Forza Tuning and Performance and may not be given to me.

I hereby hold harmless, and release my vehicle from all liability and cause of action of which I, or any other persons may make while acting on my behalf or on behalf of my property or estate.

I acknowledge, desire and agree to hold harmless and indemnify Forza Tuning and Performance from any and all liabilities, losses, claims judgements, suits, fines, penalties, demands, expenses, including but limited to all reasonable costs for defense and investigation thereof claimed by anyone by reason of operating above mentioned vehicle for anything other than the intents and purposes.

Furthermore, I agree to adhere and abide by all state and/or federal laws, rules, and regulations as it pertains to instructions on vehicle operation in its entirety as instructed by state and federal government. (This acknowledgement includes but not limited to the aforementioned vehicle and the land it's inhabiting) I release Forza Tuning and Performance and its employees and contractors of any and all liabilities and/or responsibilities if such violation and/or infraction occurs.

Emission laws are different in every state but no state allows the catalytic converters be removed from street legal vehicles operating on public roadways. Cars used for race purposes only may have less restrictions depending on state. We recommend checking with your state laws regarding catalytic converters for cars intended to be used for race purposes only.

I acknowledge and understand Forza Tuning & Performance is not responsible for damage caused by theft, fire or acts of nature.

I hereby authorize the above repairs, including sublet work, along with the necessary materials.

Forza Tuning and Performance and its employees and contractors may operate my vehicle for the purpose of testing, inspection & delivery at my risk.

I further acknowledge that (when applicable), a storage fee of $55 per day will be applied to vehicles which are not claimed or paid for within 7 working days of notification of completion.

I acknowledge that once I submit a build deposit that my deposit will be used to start ordering parts for my future installation at Forza and that I cannot receive a refund or return parts ordered through Forza Tuning and Performance. I understand that I am able to take my parts with me if I choose to discontinue my build after submitting a deposit. To use your existing parts order as a credit for a similar build with the same parts, approval from Forza Tuning and Performance is required, and is strongly not advised considering the volume and time frame of the build operations within which Forza works.

Your car will be at a power level that requires the highest quality fuel available and running anything less can easily damage your engine. We recommend Shell fuel exclusively. If you do not have Shell in your area, we will make a recommendation based on your particular geographic location.

If Shell 93 octane is available then this should be the only fuel used and we require 1oz Boostane Professional per gallon of fuel added to maximize safety and power.
If only Shell 91 octane is available then this should be the only fuel used and we require 2oz Boostane Professional per gallon of fuel added to maximize safety and power.
VP MS109 race fuel is mandatory any time the vehicle will be driven at a track, raced or any harsh driving condition. This is the only race fuel approved for use in your vehicle.

***Important: Warranty is voided if fuel recommendations are not followed exactly as recommended. ***

- Warranty on parts: Please call manufacturer for warranty details.
- Warranty on labor: 12 month or 12,000 miles, whichever comes first. Warranty voided if any of the mandatory break-in procedures or guidelines are not followed exactly.
***Important: Warranty is voided if onboard computer systems (Monitor, Mileage, Clutch Temperatures, Input & Output Shaft Speeds, Clutch Slippage Percentages, Over-Rev Counter, Over Temperature) parameters exceed mandatory break-in procedures or guidelines. ***
***Important: Warranty is voided if engine or transmission calibrations have been altered in any way from what the vehicle left with or if flash counter reports vehicle has been flashed after leaving. ***
***Important: Warranty is voided if fuel recommendations are not followed exactly as recommended for your package. ***
